Auditor Awaits Next Moved in School Issue

By Stacey Creasy

PLYMOUTH Marshall County Auditor Jan Quivey is not sure where the Indiana Supreme Court ruling leaves his count on the petition drive as part of the remonstrance pro-cess.

He is not sure whether he should or if he should proceed in counting certain votes and looking at other votes that have been questioned since then.

As part of the remonstrance process each side conducted a 30-day petition drive.

With all the questions that surround the issue, Quivey is going to wait and consult with Marshall County Attorney Jim Clevenger when he returns from vacation Monday.

The Supreme Court breathed new life into the ongoing battle between the Marshall County Tax Awareness Committee and the Plymouth School Corporation over the proposed $26.4 expansion project.

The high court ruled certain the committees names on the petitions should count; school supporters who were disqualified for the same reason will also count.

That would make the final county really close, Quivey said.

In its ruling, the high court said the committee and the school corporation went outside the boundaries of state law when putting together a Memorandum of Understanding, which was used as the guidelines for the hearings. Even though the ruling surprised Quivey, he does not feel he made any mistakes.

As county auditor, Quivey is supposed to be an objective referee in the process, the one who administers the remonstrance to both sides. He cannot interpret rules.

Quivey said there are three attorneys who agreed with the memorandum.

Those are the rules the two sides came up with, Quivey said. I applied the rules they agreed upon.
