Whitley City mother Alice Rose and her 10-year-old daughter Ashley died after their 1997 Hyundai was struck by a sheriffs cruiser forcing the car up this bank in front of the Whitley City Kroger-USave last year.
Deputy involved in double fatality sued by family of victims
By JANIE SLAVEN
Record Staff Writer

The family of Alice and Ashley Rose, killed last August when a McCreary sheriffs cruiser slammed into their car, is suing the deputy who was driving.
Deputy Jeramy Thompson is protected by the county's insurance policy, and McCreary County itself was not named in the litigation filed last Saturday.
The suit was filed jointly by Whitley City attorney Tim Lavender and Corbin attorney William Gary Crabtree. Lavender is representing Charles Rose Sr., husband to 28-year-old Alice and father to 10-year-old Ashley and nine-year-old Charles Axl. Father and son were both seriously injured in the late-night collision. Charles Rose Sr. is suing on behalf of himself, as guardian to Charles Axl Rose, and as administrator of the estate of Ashley Rose.
Crabtree represents David Rose, who is administrator of Alice Roses estate.

A concerned McCreary Countian (6/10/2026)
Well I for one think that Mr. Thompson is responsible for this horrible loss. If it were anyone else other than a police officer they would have been arrested and charge that very night. And from what I understand Mr. Thompson has not been charged with anything. In my opinion everyone should be treated the same in a case like this. It seems to me this county should be outraged. It could have been any of us, or one of our family members that he hit like that & I for one think about that alot. I worry when my grown children are on these roads now and I hear a siren. I have to call all of them, my sister & most of my family to make sure they are all home and safe. People think about it, how would you feel if it were you & yours going through this? I would only hope that the county I have grown up in would support me. We need to do the right thing and give the Rose family our sympathy and our support.

A Friend of the Rose Family (6/9/2026)
One thing I really do not like about McCreary County is all of the gossip and rumors that go around this place. People will talk about others even when they have no ideal what they are talking about. I am very close to The Rose Family so I thought I would add some actual truth to this discussion. To begin with Charles Rose has not remarried!!! He loved and misses his wife very much, as well as his daughter. His family was his whole life. Him and Alice were together for 12 years. Imagine being with someone everyday for 12 years and then one day waking up in a hospital truma center because you body is so broken up the doctor's don't even know if you'll pull through to find out that you will never again get to talk to them or see them. And your child is gone as well, never to hug or anything else, EVER AGAIN! Do the people of McCreary Co. know that both of his legs and arms were broken, his liver and splene were cut open, and his head was busted open. A couple of days after arriving at UT he turned almost orange from his liver being cut open. Bile built up within his stomach and they had to place drain tubes in either side of his stomach. His organs had to taken out and cleaned because the bile caused chemical burns on them. It was so bad that they cut a hole in his stomach and left it open in order to do more surgeries. There was really no sense in having to keep cutting him open over and over and over and over. He remained in the Truma Center for almost two months. Most of this time they kept him knocked out. Once when he woke up they had to tie him down because he wanted to get up and walk. He hated being tied down but with both legs broke there was no way he could have even stood up. His mother pretty much lived in the waiting room. She only got to see him four times a day for 20 mins. each time but there she sat day and night just waiting to see her son. Speaking of son's lets touch on Lil'Charles shall we. Lil'Charles turned 9 years old in August, almost 2 weeks before the wreck. He is just a young boy. A boy that remembers his mother and father screaming out each others names and then just screams as they were flipping over and over. He was left alone in the mangle of metal that had been a car. He was trapped inside and had to cut out. Compared to the others he was the lucky one having only a couple of broken ribs and a banged up face and a pulled muscle in his shoulder. In an instant his mother and sister were taken away and while his father remained in the Truma Center Lil'Charles could not see him. Not that it would have been good for him to see his father anyway due to the condition he was in. There were a couple of times he almost died as well. So there was Lil' Charles at 9 years old having to try to deal with the loff of his family. I remember at the funeral him saying good-bye to his mothers and sisters closed caskets, telling them he loved them. Does McCreary Co. know that this boy talks in his sleep and when he does he talks of his mother, sister, and the wreck. Once he even jumped up running and hollering. So there you have some of THE TRUTH. I beg McCreary Co. residents to seek facts before discussing the lives of others that they know little about. Thank You.

people of this county, you know what the right thing is, let justice be served!!!!!!!!!!!! ps. everybody has their judgement day in front of god!!!!!!!!!!!!!!!!!!!!

worried (6/9/2026)
this is in remarks to c.e.p.d.,this is not the work of god this is the work of the devil and as far as our county deputies go they all don't have traing, iknow mr.thompson didn't have and about all of the other things your talking about, well you just don't know what you are talking about!!!!!!!!

Jonathan Hearld (6/9/2026)
I will agree with you sir or maam to a certain extinct. When God plans to take someone then that is His plan. But do you think he planned a cop going over 100 m.p.h to take 2 wonderful people from their family? I don't think that was God's plan.I understand that the police officer involved was hurt, and he may regret what he has done, and I somewhat feel for him.He now has to live with the fact that because of what happened, and that 2 people were killed,he has to live with that for the rest of his life.He probably feels hurt and is very sorry for what has happened. He even put his life in danger. There are many Law Enforcement Agencies are no longer letting their officers chase people,or they are rewriting their policies and making it clear when to chase and not to chase people, and if they are not in pursuit and are responding to an emergency situation, they must drive at a reasonable speed and using caution. And as far as cameras on the outside of Kroger-U-Saves parking lot,I don't think it would show much or anything that happened, there is a small hill going south and the camera wouldn't have shown this officer going that fast, going at that type of speed,it just takes a split second to crash into another vehicle, and also as a surveilence camera sometimes they rotate and only show so many images a few minutes and back to the other again. And the camera may not even reach as far as the intersection and the main road. BUT ONCE AGAIN,THAT"S ONLY MY OPINION

C.E.P.D (6/9/2026)
In regards to the articles I read in the June 8, 2026 Record, I would like to add that it was a terrible tragedy - as it always is, but I also think that when GOD plans to take you, then you will go regardless of the circumstances and GOD has had his plan in place for you long before you were born. I guess this goes along with the quote "It pays to ready because you never know when your time here will end on this earth". However, I also think that some of the responses I have read were incorrect such as the comment about our Sheriff and County Govt. allowing this to happen. What's this???? An administrator is much like a parent who oversees, guides and serves as a positive role model for thier children. If your child becomes a drug addict, is it necessarily the parents fault? Are you with them when they take the drugs? If not then it is probably not your fault, but could be if you are aware of it and do not try and correct it. I was also shocked to read about the training of our deputies. It is my understanding that all deputies must complete the academy successfully at the county's expense in order to keep thier jobs. I have also found that once they complete the academy, they then apply in surrounding county's where they are offered higher wages-and who wouldn't want a higher paying job? As for the hiring process, I believe that Mr.Thonpson was hired under the administration of our previous Sheriff and continued under the present Sheriff. I think Sheriff Perry is not at fault nor our County Govt. As for rumors, we hear all sorts of things. I would like to know if this accident was actually caught on tape by cameras in the parking lot?, were drugs involved?, What about the state trooper-was he negligent? These are things that we will probably never know and is probably none of our buisness. I am sure the suit will result in monetary value-that's why we are required to have insurance and with a tragedy such as this, they deserve it. I believe that Mr. Rose has remarried and I wish him and his family all the happiness in the world, but I also extend that to Mr. Thompson who can now no longer work and must live with the pain and sorrow every day of his life. To Sheriff Perry-keep up the good work. I see you out every day working traffic, traffic accidents, and directing traffic in congested areas. I have also witnessed seeing you at several school related events and I am suprised at the number of children who know and recognize you. I think this is wonderful for our youth and our community as a whole. Most children are afraid of law enforcement because of negative comments they have heard or read, but if mine are in trouble or lost, I know they would not hesitate to come to you and for that I thank you! God Bless all who are involved and their families.

Theresa (6/7/2026)
I think we should all be held accountable for our actions and that includes police officers here in this county. The whole community suffers when there is a loss like this. A child was taken away before she got to live much of her life, a mother was taken away from her son who survived this awful wreck. He will never have the joy of hearing her say i love you son or i am proud of you son. I think it was neglect and Mr. Rose & his son are the true victims. I wish them all well and my prayers are with the Rose family.

Jonathan Hearld (6/5/2026)
I see that this is a hot topic,I will write more on this subject momentarily at Mccreary County News at the Public Opinion Forum, this will let you see some of the research that I have gathered up.

worried! (6/4/2026)
I totally agree! It is gross negligence, completely!I beleave the law is there to protect and serve us and should, but that wasn't protecting or serving us,that was being careless, totally!I mean think about it!The deputy was called as backup to threatened suicide that a statetrooper was already at!The deputy shouldn't have been going over 100mph through the most congested area in the county, besides the deputy was called off before the accident happend! If the county trained their deputies they would know not to go that fast especially through a gongested area like that!I mean the law should do their job but they can go outside congested area's to chase the person! Plus the person, they can't outrun the radio, the law should try to outsmart them, not only chase them! I think if anybody should become deputy or a sheriff they should have training! You don't see the statetroopers doing that! My heart goes out to the mother and daughter that died in the accident and to the husband/father and son/brother! they suffered the most and will the rest of their lives! Think about it people, it's not right, justice should be served!!!!!! But that's only my opinion!

McCreary County Citizen (6/4/2026)
We seem to be forgetting that this was not a cop and robber chase, there was no drunk driver or anyone else being chased. This was a call on someone threatening to commit suicide. Someone that wanted to harm themself and two other people lost there lives over this! A young adult and A CHILD who had many years to look forward too. Why drive at that rate of speed and endanger others over one person that can't deal with life? I just don't understand.

Jonathan Hearld (6/4/2026)
To the Police Officer: How can officers chase people and endanger more people's lifes than what they already are? I have witnessed a police chase several years ago, that claimed a man's life, all over because he stoled a bag of chips and a pop,and the police chased him.It is my opinion that when police starts chasing, that only gives the indvidual more of an anticipation to drive faster. It is my opinion that Police officers should respond as quick as possible,BUT NOT 100 MILES AN HOUR! Let it be known I do have respect for Officers, and I have never been in trouble with the law.An officer never knows what he might expect, and I believe they should also make more money than what they do,they are way underpaid for the job that they have to do.If a person fails to pull over, that's when backup should be called, and if another county should be called in,they should be called in.I respect your opinion, and in return,I hope that you can respect mine. Since you are an Officer, one thing you should be able to agree on is that Kroger U Save is already a death trap, and that by going that fast in that area is risking bodily harm to everyone that is around that area.I respect you that you are an officer and you put your life on the line of protecting citizens,I am in no way trying to put officers down in any way,I am just stating my opinion, and I am sure alot of people may disagree with alot of stuff that I write about, and also there is alot of people feel the same way that I do.It is not my intentions of hurting anybody or putting people down,so if I have hurt anyone by telling my opinion,I AM SORRY,AND I HOPE THAT YOU CAN ACCEPT MY APOLOGY. But Once Again,That's Only My opinion.

The other side of the story (6/4/2026)
To Mr.H: I am a police officer and I do agree that the deputy was not exercising due regard for public safety as established by KRS. However, how can officers perform their jobs and serve you and other citizens if we do not chase suspects or respond to emergencies as quick as possible. It is not as easy as getting a license number and then "go get them". Some vehicles are operated by people who are not registered owners, have different addresses, or maybe even stole the vehicle. What if they are drunk and decide not to pull over, I turn my lights off and go the other way, they hit your family on down the road. I am sure you would be asking why the officer did not pursue the person then.

Mr D (5/31/2004)
Isnt there a KRS code that says emergency vehicles are permitted to drive 15mph over the posted limit responding to emergencies? Hmmmm, A Sheriff Dept. Vehicle traveling at 100mph in a 35mph zone, sound like gross negligence and disregarding the publics safty too me. Sheriff Perry and the County Govt. both need sued for allowing this too happen. After all the county govt. approves of what deputies the Sheriff hires regardless of their training. This accident could have been avoided. But will the county govt get involved too prevent this from happening again? I dont think so.

Stacy Holbrook (5/31/2004)
You travel 1 mile in 1 minute going 60 miles an hour. At almost double that imagine how fast you can travel a mile. Why would you not feel safe enough to pull out when you don't see anything coming. From U-Save looking south there is a small hill where you can only see so far, nobody would expect not to see anyone and then have someone there in a second.

Terry Chad Clark (5/29/2004)
I think it was the victim's falt for pulling out in front of him, but I wish the family well.

(5/27/2004)
It could have been your family!!! Think about it!

Friend of the Family (5/25/2004)
I completely agree with Mr. Herald. A cop should be held accountable for his actions just like everyone else. He took two wonderful people from us and changed the lives of two forever. Justice should be served.

Jonathan Hearld (5/25/2004)
I also would like to add that I understand this cop wasn't chasing anybody, but was responding to an emergency situation. But still, my opinion is still the same. He not only endangered those who died in this wreck, but also to the father and the son, as well as other drivers, including himself.

I have read that witnesses said she pulled out in front of him. At a speed over 100 miles an hour, anybody pulling out of Kroger-U-Save would've pulled out, because at that type of speed nobody would've seen this cop coming.

Not only is this cop at fault, the County Sheriffs office is at fault as well for letting their officers drive at this kind of speed. They are to protect us all, that includes driving at a reasonable speed at all times including emergency situations, especially at intersections such as Kroger-U-Save's

Jonathan Hearld (5/25/2004)
I hope they win their lawsuit. I don't think cops should go that fast, and they should not chase another driver, for what usually happens is quite obvious, seriously injuring someone innocent or causing death to another human being. They should instead get the person's license number, then go get them.

The person that they are chasing may run, but they can't hide!

And furthermore, a cop has no business going that fast in the busiest part of Whitley City, that is a death trap anyways, and it was his fault.

They should also sue the County as well.

But again, that's only my opinion
