Not Out of the Woods: Eviction case heads back to court
By JANIE SLAVEN Record Staff Writer
WHITLEY CITY It appears that the property dispute spawned by ex-master commissioner Charles Kings failure to return proceeds from a sale will continue. Pine Knot businessman Jerry C. Stephens has filed a motion in McCreary District Court asking the court to compel Thelma Wood Cornelius to vacate her home. Judge Cathy Prewitt declin-ed to rule on the case last month, stating that the case should be resolved in Circuit Court because the home was sold in October 2002 as part of a master commissioners sale ordered in McCreary Circuit Court to settle the estate of Cornelius father, John Wood. Stephens bought the property for a reported $234,500 from then Master Commissioner Charles King. But when King failed to distribute funds from the Wood and another sale, the ensuing investigation led to his indictment on 140 counts of Theft by Failure to Make Required Disposition. It was also discovered that King had been serving in the appointed post for several years without a bond, required by law to ensure against wrongdoing. Stephens and Cornelius are scheduled to appear in District Court on Sept. 15 regarding the eviction notice.

lee (9/21/2004) No,this case didn't start in the courts! It started with Mr.King who done wrong, who done the crime but doesant want to do the time or see that this lady gits her home back.Shame on you Charles King,God has a strange way of paying you back...the right thing to do is to see that this lady gits her home back.
Someone with a heart (9/21/2004) Ok let's try this again!! last week i wrote my comment about this story and for some reason, it must have not been good-enough to print.and i wonder was it not good-enough because i spoke the truth?? i don't know this Lady but i think it's a shame she is being made to leave her home, with know where to go, and no money to buy a house, like i said before.the biggest reason this is such a shame is that the one who is trying to make this lady leave has more money than he know's what to do with!! it look's like he would have a heart and let her stay in the only place that she know's as HOME. To Mrs. Woods I hope that everything work's out for you and God Bless You.
Confused (9/9/2026) I don't understand this case. The problem started in the circuit court, and I'm assuming, somehow, it was appealed down to the District Court. maybe, I just don't understand those CUSTOMARY LAWS.
