Access Cable wins 10-year franchise; owners promise improvements
By JANIE SLAVEN
WHITLEY CITY For the time in more than 30 years, the McCreary County Fiscal Court has officially awarded a new cable franchise. At their April meeting on Tuesday morning, magistrates approved the first reading of a 10-year agreement with Somerset-based Access Cable for cable television services. Access owner Roy Baker first addressed the court about formalizing an agreement several months ago, but several sticking points delayed the process. First, Baker had wanted to pay as franchise fees four percent of generated revenue while the court wanted to maintain the current rate of five percent. Baker noted that the issue was resolved with the General Assembly passing the new tax reform bill, with both cable and satellite customers paying a consumer tax which will be disbursed to counties by the state. The court also hoped to limit the contract to four years, but ultimately agreed to 10. Baker had wished to set the minimum for expansion at 30 homes per contiguous mile but agreed to the courts request for 20. Magistrate Roger Phillips expressed concern over the omission of a limit on rate increases. However since the industry was deregulated, including such language in the contract would be illegal, according to Baker. They [the federal government] leave it up to the marketplace to determine the rates, Baker said. If you put that in the agreement, that would rate regulation.
